Criminal Background Checks for Employers in South Africa
Criminal Background Checks for Employers in South Africa
What an employee background check shows, the consent POPIA requires, and the mistakes that delay or undermine a hire.
The short answer
Employers in South Africa can run criminal background checks on candidates and staff, with the person’s consent. Information about criminal behaviour is special personal information under the Protection of Personal Information Act (POPIA), so it has to be handled with more care than an ordinary CV.
A background check tells you whether a person has a criminal record, based on official records. Through Police Clear, the standard turnaround is an estimated 24 to 48 hours, with same-day and express options on request, subject to availability.

What a criminal background check shows
A criminal background check is a fast verification of whether a person has a criminal record. It is a screening report for decisions made in South Africa, such as hiring, licensing and registration.
It is not the same document as a police clearance certificate. The police clearance certificate is the official SAPS certificate used for emigration, visas and travel or employment abroad. If a candidate needs a document for a foreign employer or a visa, a background check will usually not be accepted.
When employers run background checks
- Pre-employment and post-employment screening
- E-hailing driver applications, such as Uber and Bolt
- Gambling and liquor licensing
- Registration with regulatory bodies, including the National Credit Regulator, the South African Council for Educators and the South African Institute of Taxation
Roles that involve children
Organisations where staff work with or have access to children carry separate legal duties. Under the Children’s Act, before a person is allowed to work with or have access to children at certain institutions, the person managing the institution must establish whether that person’s name appears in Part B of the Child Protection Register. The National Register for Sex Offenders exists for the same protective purpose.
These registers are separate from the criminal record. A criminal background check does not replace them, and an employer in this position should run all the checks that apply.
Consent and POPIA
Criminal behaviour is special personal information under POPIA. Section 26 restricts processing information about the alleged commission of an offence, and about proceedings in respect of an offence.
It can be processed where there is a lawful basis. The one that applies to most employers is consent: section 27(1)(a) allows processing with the consent of the person concerned. POPIA also requires information about your own staff to be processed in line with labour legislation.
In practice, that means:
- Get written consent from the candidate or employee before the check is run
- Tell them why the check is being done and what it will be used for
- Limit who sees the result, and store it securely
- Use it for the decision it was obtained for, not for anything else
How a result is used in a hiring decision is a labour law question as well as a data protection one. A record is not automatically relevant to every role, so take advice on how to apply results fairly before you build them into a policy.
What goes wrong, and what it costs you
Running a check without written consent. The check itself becomes a POPIA problem, whatever it shows.
Relying on a name-only search. Names and ID numbers can be mistyped or shared. A check that cannot be tied to the right person is worse than no check, because it looks like an answer.
Poor fingerprint capture. Where fingerprints are part of the check, unclear prints slow it down, and on a tight start date that can cost you the candidate.
Using the wrong document. A background check accepted for a local hire may not satisfy a foreign employer, an embassy or a regulator that asks for a police clearance certificate.
Checking too late. A check run after the start date, or after a contract is signed, leaves you managing a problem instead of avoiding one.
Keeping results where anyone can see them. Special personal information left in shared inboxes or open folders is a POPIA exposure of its own.

How long does a criminal background check take?
Through Police Clear, an estimated 24 to 48 hours as standard, with same-day and express options on request, subject to availability.
